Analizom ponude vezano uz ispunjenje zahtjeva u pogledu opisa predmeta nabavke i tehničkih specifikacija,a u skladu sa tačkom 4.1stav h tenderske dokumentacije konstatovano je da ponuđač „DEFTER“ d.o.o Sarajevo nije dostavio tehničku specifikaciju predmeta nabavke uz precizno navođenje naziva proizvođača i tipa/ modela robe koja se nudi i koja mora biti u skladu sa  tehničkom specifikacijom koja je navedena u tenderskoj dokumentaciji što je bio razlog njegovog isključenja iz daljeg postupka Javne nabavke. \r\nDaljom analizom je utvrđeno da sljedeći prihvatljivi ponuđači „ADUT PLUS“ d.o.o Banja Luka i  „HAFELEBH“ d.o.o Gračanica imaju istu najnižu cijenu zbog čega se prema kriteriju za dodjelu ugovora „najniža cijena“  ne može izvršiti izbor najpovoljnijeg ponuđača. VI tenderske dokumentacije), sadrži očitu tehničku grešku presudnog značaja, zbog koje je nužno donijeti odluku o poništenju predmetnog postupka javne nabavke, iz razloga što bi daljnje provođenje predmetnog postupka bilo protivno svrsi samog postupka. Naime, članovi Komisije su utvrdili da je u tehničkoj specifikaciji navedeno da predmet nabavke-arhivski regal mora zadovoljavati uslove visine od 3952 mm. Utvrđeno je da je očito došlo do greške u mjerenju i bilježenju dimenzija prostorije u kojoj je planirano montiranje arhivskog regala, s obzirom na činjenicu da nijedna prostorija kojom raspolaže Tužilaštvo Bosne Hercegovine, pa tako ni prostorija planirana za instaliranje predmeta nabavke  ne prelazi visinu od 3700  mm . Navedeno znači da bi nastavak postupka javne nabavke i odabir najpovoljnijeg ponuđača implicirao zaključenje ugovora sa odabranim ponuđačem koji ugovor ne bi bilo moguće sprovesti, jer bi njegovo dosljedno provođenje, s obzirom na navedene činjenice, bilo moguće samo u slučaju stvaranja trenutno nepostojećeg prostora za smještaj predmeta nabavke, koji prostor bi se mogao stvoriti isključivo rušenjem stropa prostorije u kojoj bi bio montiran predmet nabavke, koji navedeni strop predstavlja pod prostorije sa sprata iznad, što praktično dovodi do nemogućnosti ispunjenja nacrta ugovora priloženog uz tendersku dokumentaciju. Daljnje provođenje postupka javne nabavke i zaključenje ugovora za kojeg ugovorni organ unaprijed zna da nije provodiv predstavljalo bi netrasparentno postupanje, odnosno postupanje protivno odredbama člana 3. Zakona o javnim nabavkama koje govore o transparentnosti postupka javne nabavke. Pored toga, takvo postupanje bilo bi protivno i imperativnim odredbama člana 3. ZJN, koje propisuju da se postupci imaju provoditi sa ciljem najefikasnijeg korištenja javnih sredstava u vezi s predmetom nabavke i njegovom svrhom, a očito je da bi se zaključivanjem i pokušajem provođenja neprovodivog ugovora na opisani način stvorili ogromni troškovi (a imajući u vidu i činjenicu da je cijena predmeta nabavke u direktnoj zavisnosti od njegovih dimenzija, odnosno zapremine) , odnosno došlo bi do neopravdanog i nepotrebnog rasipanja javnih sredstava, iz čega proizilazi neophodnost donošenja odluke o poništenju predmetnog postupka javne nabavke.
